Our approach

We respect copyright and respond to notices of claimed infringement under the Digital Millennium Copyright Act (DMCA). We end the accounts of members who repeatedly infringe.

Send a notice

If you believe content on trvl up infringes your copyright, use the form at /legal/report or send a written notice to our designated agent:

Designated agent: ZT Management Limited Company, 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110. Email: [email protected].

Your notice must include:

  • your physical or electronic signature;
  • the work you say was infringed;
  • the content on trvl up you say infringes it, with the page address;
  • your name, address, phone and email;
  • a statement that you believe in good faith the use is not authorized by the owner, its agent or the law;
  • a statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized to act for the owner.

What we do

When we receive a valid notice we remove or disable the content, tell the member who uploaded it, and may share the notice with them. Knowingly false notices can make you liable for damages.

Counter-notice

If your content was removed by mistake or misidentification, you can send a counter-notice that includes:

  • your signature;
  • the content removed and where it appeared;
  • a statement under penalty of perjury that you believe in good faith it was removed by mistake;
  • your name, address and phone, and consent to the federal court in New Mexico (or your home court if outside the US) and to accept service from the person who sent the notice.

Restoring content

After a valid counter-notice we pass it to the person who complained. If they do not tell us within 10 business days that they have filed a court action, we may restore the content.
